New Law Effective September 1, 2005
It Is still legal to provide Flat Fee Listing services in Texas, if certain guidelines are followed.
Despite strong objections by the Department of Justice and Federal Trade Commissions Anti-Trust divisions, and
consumer rights organizations, the Texas Legislature and Governor Rick Perry signed into law SB 810 on June 19,
2005.
This new law forces real estate brokers to provide a minimum level of services, whether you as the seller want
them or not.
One of the major provisions of the law is that it forbids the buyers agent from negotiating directly with you, the
seller, but the law is vague on what constitutes "negotiating".
The law states that your broker must answer any and all questions asked by the seller during the transaction;
however, if you have no questions during the transaction, then there is no violation of the law if you handle your
own transaction. To assist you in successfully completing your property sale, Memorial First Realty will grant you
access to our FAQ Center (frequently asked questions), where there is a wealth of knowledge at your disposal to
help answer any questions you may have concerning your real estate transaction.
If you cannot find an answer to your question at the FAQ Page, your agent will always be available to answer any
questions you may have via email or fax. If you feel you need more personalized attention, you should consider
switching to our Flat Fee with Service Plan, or obtain the highest level of service through our Discounted Full
Service Listing Plan. Either of these plans will save you thousands of dollars from conventional brokerages, yet
still offer an exceptional level of service and value not often found in the industry.
Finally, offers made on your property may be "delivered" directly to you, but must also be sent to your agent.
Any offers your agent receives will be forwarded to you via email or fax.
